General Terms and Conditions (GTC) of Marbledworks GmbH for the online shop polpo.world

§ 1 Scope and Provider

These General Terms and Conditions (GTC) apply to all contracts concluded between Marbledworks GmbH, Clemensstrasse 26, 80803 Munich, Germany (hereinafter "Seller") and you as our customer (hereinafter "Customer") via the online shop www.polpo.world. The brand "polpo" is a brand of the Seller.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal personality who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

These GTC shall apply exclusively. Deviating, conflicting, or supplementary GTC of the Customer shall only become part of the contract if and to the extent that the Seller has expressly consented to their validity.
§ 2 Conclusion of Contract

The presentation of goods in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

By clicking the final order button (e.g., "Buy Now") in the last step of the ordering process, the Customer submits a binding offer to purchase the goods in the shopping cart.

The Customer will immediately receive an automatic order confirmation by e-mail from the Shopify system. This order confirmation constitutes the Seller's acceptance of the Customer's offer, whereby the purchase contract is concluded.
§ 3 Special Provisions for Pre-orders ("Coming Soon")

For products marked as "Coming Soon" or "Pre-order", the delivery time stated on the product page is an estimated and non-binding delivery date. The Seller will inform the Customer of any significant delays.

The purchase price for pre-ordered goods is due immediately upon conclusion of the contract.

The statutory right of withdrawal (see § 8) also applies to pre-orders and begins upon receipt of the goods.
§ 4 Prices, Payment, and Shipping

All prices quoted in the online shop are final prices in EUR and include the statutory German value-added tax (VAT).

Any applicable shipping costs are not included in the purchase price, are shown separately during the ordering process, and are to be borne by the Customer. Detailed information is provided on our "Shipping and Payment" page.

Payment can be made using the methods offered during checkout.
§ 5 Delivery, Customs, and Transfer of Risk

Delivery shall be made to the delivery address specified by the Customer. Information on delivery times can be found on the respective product pages and on our "Shipping and Payment" page.

For deliveries to countries outside the European Union, we provide a Delivery Duty Paid (DDP) service. This means that all applicable import duties, customs fees, and local taxes are calculated and collected directly at checkout. The total amount you pay when completing your order is final, and there will be no additional charges upon delivery. The Seller will handle the customs clearance and payment of these fees on your behalf.

For consumers, the risk of accidental loss and accidental deterioration of the goods sold shall pass to the consumer upon handover of the goods. For entrepreneurs, the risk shall pass to the carrier upon handover of the goods.
§ 6 Retention of Title
The delivered goods shall remain the property of the Seller until the purchase price has been paid in full.
§ 7 Liability for Defects (Warranty)
The statutory provisions for liability for defects shall apply. The warranty period for new goods for consumers is two years from the date of delivery.
§ 8 Right of Withdrawal for Consumers (Cancellation Policy)

Consumers are generally entitled to a statutory right of withdrawal.

The right of withdrawal may not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice by the consumer is decisive or which are clearly tailored to personal needs.
§ 9 Liability
The Seller's liability is governed by the statutory provisions.
§ 10 Data Protection
Information on the processing of the Customer's personal data can be found in our separate Privacy Policy.
§ 11 Final Provisions

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

The contract language is English.

Should individual provisions of these GTC be or become ineffective, the validity of the remaining provisions shall not be affected.

If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contractual relationship shall be the Seller's place of business (Munich).
